The State of California passed SB 1383 to reduce organic material sent to landfills. County and city agencies are tasked with implementing the law and fines are now being assessed to businesses that do not have compost and recycle programs. OCIC is here to help merchants and business owners understand the law and requirements for composting and recycling. OCIC is not assisting with enforcement, but rather here to help you get the information you need.

Did You Receive a Violation Letter?

Notice of Violation letters are sent to warn businesses that do not have the required compost and recycle service. Citations and fines are issued to sites that fail to obtain the required service after the warning letter.


  • Subscribe to compost service for your business by contacting Waste Management of Alameda County (WMAC) at (510) 613-8700 or visiting www.wm.com.
  • Subscribe to recycle service for your business today. Choose from a list of service providers.
  • If your business generates a very small volume (less than 10 or 20 gallons a week) of compostable or recyclable material apply for a minimal generation waiver at www.StopWaste.org/rules-waivers

Understanding the Law


Under state law SB 1383, all businesses, nonprofits, institutions, schools, and multifamily properties in Alameda County are required to have compost and recycling collection service or have an approved waiver. The City of Oakland partners with Alameda County public agency, StopWaste, to implement and enforce the law under the local Organics Reduction and Recycling Ordinance and Oakland Municipal Code Chapter 8.28.


StopWaste has begun issuing Citations for non-compliance. Starting fines range from $50 to $100, depending on the size of a site’s trash service. Fines may increase every 60 days, with fine amounts up to $500 for any sites that continue to not have the required service. For additional information, visit: www.StopWaste.org/rules

Don't let good food go to waste! SB 1383 also requires some sites that generate surplus edible food to donate food to feed people. Local organizations are ready to accept your leftover food for donation to those in need. Donate produce, prepared foods and baked goods so that they can be distributed to the community. Many of the organizations listed will come to your business to pick up the food. Listed below are some of the food recovery organizations that work in the City of Oakland.
